What happens if I die without a will?

If you die without a valid will in England and Wales, you die 'intestate' and the law decides who inherits your estate through fixed intestacy rules.

Under intestacy rules:

  • Unmarried partners get nothing - even after decades together
  • Stepchildren get nothing - unless legally adopted
  • Your spouse may not get everything - they might only get half if you have children
  • The courts decide who looks after your children - not you
  • Friends and charities get nothing - no matter how close or important they were

Intestacy also means higher legal costs, longer delays, and often family disputes. Your estate could take 12-18 months or more to sort out, compared to 6-9 months with a will.
