Why Islamic Wills Are Different (3-Minute Read)
Islamic wills follow the principles of Fara'id - the Islamic law of inheritance based on the Qur'an and Sunnah.
🕌 Key Principles
1. Fixed Shares (Fara'id) Allah (SWT) has specified fixed shares for certain relatives in the Qur'an. These shares are mandatory and cannot be changed.
2. Two-Thirds Mandatory Distribution At least two-thirds (and often more) of your estate must be distributed according to Fara'id.
3. One-Third Discretionary (Wasiyyah) Up to one-third of your estate can be given as you wish (bequests to charity, non-heirs, etc.).
4. Males Typically Receive Double Females Generally, male heirs receive twice the share of female heirs in the same category (with important exceptions).
5. Debts and Funeral Expenses First All debts and funeral expenses must be paid before any distribution.

- ✗ May contradict your religious obligations

Fixed Shares Explained (5-Minute Read)
Fara'id are the fixed shares specified in the Qur'an for certain relatives.

👥 Who Gets What Share?
Note: These are simplified. Actual shares depend on who else is alive.
SPOUSE'S SHARE
Wife (if husband dies):
- 1/4 if no children or grandchildren
- 1/8 if there are children or grandchildren
Husband (if wife dies):
- 1/2 if no children or grandchildren
- 1/4 if there are children or grandchildren
PARENTS' SHARES
Mother:
- 1/3 if no children and no more than one sibling
- 1/6 if there are children or 2+ siblings
Father:
- 1/6 if there are children
- Residuary (everything left) if no children
CHILDREN'S SHARES
One Daughter (alone):
- 1/2 of the estate
Two or More Daughters:
- 2/3 shared equally among them
Sons:
- Residuary heirs (asaba) - receive what remains after fixed shares
- Each son receives twice what each daughter receives
Mixed Sons & Daughters:
- All children share the residuary
- Sons receive 2x daughters
📖 EXAMPLE: Sons and Daughters
Estate value: £120,000
Children: 2 sons, 1 daughter
Distribution:
- Total shares = 2+2+1 = 5 shares
- Each share = £120,000 ÷ 5 = £24,000
- Each son: 2 shares = £48,000
- Daughter: 1 share = £24,000
SIBLINGS' SHARES
Full Siblings:
- Receive shares only if no children or grandchildren
- Males receive 2x females
- Specific fractions depend on number and gender
Half-Siblings:
- Lower priority than full siblings
- May be excluded by full siblings
🔄 Residuary Heirs (Asaba)
After fixed shares are distributed, remaining estate goes to residuary heirs in this order:
- Sons (and grandsons if no sons)
- Father (if no sons/grandsons)
- Grandfather (if no father)
- Full brothers (if no descendants or father)
- Half-brothers (if no full brothers)
- And so on...

Distribution:
- Wife: 1/8 = £37,500
- Remaining: £262,500 (residuary for children)
- Son 1: 2/5 of £262,500 = £105,000
- Son 2: 2/5 of £262,500 = £105,000
- Daughter: 1/5 of £262,500 = £52,500
Scenario 2: Married, No Children
Family: Husband dies, leaving wife, mother, father
Estate: £200,000
Distribution:
- Wife: 1/4 = £50,000
- Mother: 1/3 of remainder = 1/3 × £150,000 = £50,000
- Father: Residuary = £100,000
Scenario 3: Widow with Children
Family: Wife dies, leaving husband, 1 son, 2 daughters
Estate: £400,000
Distribution:
- Husband: 1/4 = £100,000
- Remaining: £300,000 (residuary for children)
- Son: 2/5 of £300,000 = £120,000
- Daughter 1: 1.5/5 of £300,000 = £90,000
- Daughter 2: 1.5/5 of £300,000 = £90,000
Scenario 4: Parents Alive, No Spouse
Family: Person dies, leaving mother, father, 3 full sisters
Estate: £240,000
Distribution:
- Mother: 1/6 = £40,000
- Father: 1/6 = £40,000 + residuary
- Sisters: May receive from father's discretion or wasiyyah
(Complex scenario - consult Islamic scholar)
⚠️ WARNING: Non-Muslims Cannot Inherit via Fara'id
If an heir is not Muslim, they cannot receive a share under Fara'id.
However:
- They CAN receive up to 1/3 via wasiyyah (bequest)
- You can specify this in your will
Example: If your spouse is not Muslim, you cannot give them a Fara'id share, but you can leave them up to 1/3 via wasiyyah.
The Bequeathable Third (3-Minute Read)
Wasiyyah allows you to give up to one-third (1/3) of your estate as you wish.
📐 The 1/3 Rule
Maximum bequest: 33.33% of your net estate (after debts and funeral expenses)
You can use wasiyyah for:
